Public procurement
Advising on procurement in the construction sector is one of VILTOFT’s core areas of expertise.
We have a dedicated team of highly specialised attorneys who advise on all aspects of public procurement.
We have many years of experience in planning public procurement processes tailored to our clients’ procurement and project needs. We assist clients at every stage of the procurement process – from determining the procurement strategy and conducting market dialogue to preparing tender documentation, managing tender procedures and handling procurement disputes and complaints. We also advise on public-private partnerships (PPPs), early contractor involvement and other alternative project delivery models.
A successful procurement process requires thorough preparation, effective project management and specialist expertise to address unforeseen issues that often arise during the tender procedure. It also depends on close cooperation between the many stakeholders and advisers often involved. We have considerable experience in facilitating and managing tender procedures. We often work closely with our clients and their professional advisers to deliver practical and commercially sound solutions. We are accustomed to navigating the specific requirements applicable to contracting authorities and utilities and are well equipped to handle the complex legal and practical issues that frequently arise in this context.
Our clients include housing associations, local authorities and utilities. We also advise bidders participating in tender procedures, including the preparation and optimisation of tender bids and the handling of complaints. In this work, we draw on our substantial experience acting for contracting authorities. We have significant experience representing clients in procurement disputes before both the Danish Complaints Board for Public Procurement and the Danish courts.
Although construction projects are at the heart of our public procurement practice, we also have extensive experience advising on procurement matters in other sectors relevant to our clients. For example, we regularly advise on the procurement of operation and maintenance contracts in the utilities sector, as well as on procurements concerning the acquisition, implementation and operation of IT systems and services.
Public procurement law is complex and constantly evolving, and we regularly provide both introductory and bespoke training courses in this area.
