Advice on public procurement in the construction sector is one of VILTOFT’S key areas of expertise.
We have a dedicated team of highly specialised attorneys who provide advice on public procurement.
We have many years’ experience in planning public procurement processes that are tailored to our clients’ needs. We advise on all stages of the procurement process – from tender design to market dialogue, preparation of the tender documents, calls for tenders and management of complaints about tenders. We provide advice on public-private partnerships (PPPs), early involvement of contractors and alternative types of collaboration.
A successful tender process calls for meticulous preparation, project management and technical overview that make it possible to respond to unforeseen issues that occur in the process. It also calls for good, close working relationships with the – often numerous – parties and other consultants involved. We have extensive experience in facilitating and managing the tender process, and our advisory activities are generally carried out in close collaboration with our clients and clients’ advisers in order to ensure that the solutions applied will work in practice. We are used to navigating through the special requirements to which public authorities and enterprises are subject, and are able to respond to the complex legal and practical issues encountered in the process.
Our clients are primarily social housing associations, local authorities and utility companies, but we also provide advice to tenderers concerning the submission of tenders, including the preparation and optimisation of tenders and complaints about tenders. In this respect we draw on our considerable experience in working with ‘the other side of the table’. We have vast experience in conducting cases concerning tenders both before the Danish Complaints Board for Public Procurement and in courts of law.
Although construction is the focal point of our advisory services, we also have considerable experience in other fields of relevance to our clients, for example tendering for operating contracts in the utilities sector and calls for tenders for the procurement and operation of IT systems.
