Dispute resolution is a core expertise for us. We handle litigation, arbitration and cases before complaints boards both inside and outside our main practice areas. We also assist in other forms of dispute resolution.

Experienced litigation and arbitration specialists
Our assistance spans the entire process, from advice on whether legal proceedings should be instituted to assistance in connection with the taking of evidence and conducting the actual proceedings.

We often represent clients in construction disputes before the courts and the Danish Building and Construction Arbitration Board. Our clients include employers, contractors, technical consultants and insurance companies who are parties in construction cases concerning defects, delay, additional claims and liability.

We also represent contracting authorities and complainants in public procurement disputes before the Complaints Board for Public Procurement. In addition, we frequently represent clients in litigation and arbitration outside our main practice areas, for example disputes concerning public law, corporate law, M&A, competition law, contracts and general commercial law.

Within labour and employment law we have many years’ experience in representing some of Denmark’s largest employee organisations before the courts, the Unfair Dismissals Tribunal, industrial arbitration tribunals and the Danish Labour Court.

Under foreign skies
We have extensive experience in international cases and advise clients on private international law disputes concerning choice law and venue.

We handle cases involving international construction and engineering projects, infrastructure works, power stations, offshore installations, industrial plants and process plants. We have appeared before the European Court of Justice.

We know more about arbitration than most. Our lawyers represent parties and act as arbitrators in Danish and international arbitration cases, institutional and ad hoc.

We have written one of the leading textbooks on arbitration in Denmark, Danish Arbitration (“Voldgiftsret”). The book is regularly updated at Voldgiftsret.dk to include the newest case law from Denmark, Sweden and Norway.

A Solomonic solution
Far from all disputes should end in court. Together with our clients we consider the potential for out-of-court settlements and we participate in settlement negotiations when required. We also offer assistance in relation to conciliation, mediation and dispute boards as well as other types of alternative dispute resolution.

From 2004 to 2013, we have successfully represented Metroselskabet in the largest arbitration case ever before the Danish Building and Construction Arbitration Board. The case concerned contractor’s claims totaling in excess of DKK 3 billion relating to Stages 1 and 2A of the Copenhagen Metro.

In 2011-2012, we represented Metroselskabet in the largest case to date before the Complaints Board for Public Procurement regarding the tendering of the City Ring project (DKK 21 billion).

Insurance company Tryg Forsikring A/S instructs us as counsel to technical consultants in a number of court and arbitration cases concerning professional negligence in relation to projects in Denmark and abroad.
